Who's Responsible for Your Data?

The responsibility for your data depends on how you use UpLink Files.

  • If you have an individual account: UpLink Files is responsible for how your personal data is handled.
  • If you're part of a business or team account: The organization that provided your account is the primary entity in charge of your data. We process data on their behalf, following their directions.

Regardless of your account type, we may also process some data independently to meet legal requirements, secure our platform, or prevent misuse.

Contact our Data Protection Officer (DPO) at support@uplinkfiles.com for questions or requests.

What Information We Collect and Why

We only collect information that's necessary to run our service, improve it, and keep it secure. Here’s a simple breakdown:

1. Information You Give Us

This is data you actively provide when you use our services.

Information Collected Why We Need It
Account Information (Name, Email, Payment Details) To create and manage your account, process subscription payments, and communicate important service updates with you.
Your User Content (Files, Photos, Messages, etc.) This is the core of our service. We need to store and process this content to make our features work for you.
Your Contacts (Email addresses for file recipients) To send your files to the right recipients and notify them of the transfer.
Communications with Us (Support tickets, survey responses) To help you solve problems, gather feedback, and improve our services.

2. Information We Collect Automatically

This is technical data we gather as you use the platform.

  • Device and Technical Details: Your device type, operating system, IP address, and system language. We also assign you a unique user ID. This helps us optimize the service for your device, ensure security, prevent fraud, and determine your approximate location (like your country, state & city) to provide a localized experience.
  • Usage Data: Information about how you use UpLink Files—like which features you use most and what actions you take. This helps us understand what’s working and what’s not, so we can make our service better and develop new features that you’ll find useful.
  • Cookie Information: We use cookies to make our site work. You can find more details in the "Approach to Cookies" section below.

3. Information from Other Sources

Occasionally, we receive information from third parties.

  • Payment Processors: When you make a purchase, our payment partners provide us with confirmation of the transaction.

When and Why We Share Your Information

First, let's be clear: we do not sell your personal data. We only share it in specific situations where it's necessary to provide our service or comply with the law.

  • With Service Providers: We work with trusted companies that provide the technical backbone for our service, such as cloud hosting, payment processing, and security. They are only permitted to use your information to perform related tasks for us.
  • When You Collaborate with Others: If you share files or interact with other users, we will share the necessary information (like your name or email) to facilitate that interaction.
  • For Legal and Safety Reasons: We may share your information with law enforcement or other third parties if we believe it's necessary to:
    1. Comply with a law, regulation, or valid legal request.
    2. Protect the safety, rights, or property of UpLink Files, our users, or the public.
    3. Detect, prevent, or address fraud, security issues, or illegal activity.
    4. Enforce our Terms of Service.
  • With Our Departments: We share information internally between our teams for administrative functions, security, and ongoing service improvement and development.
  • In a Business Transaction: If UpLink Files is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that deal. We will notify you of any such change.

Legal Basis for Processing

For users in the European Economic Area (EEA) or UK, we rely on the following legal bases:

  • Legal obligations (to comply with law)
  • Legitimate interests (to improve, secure, and develop our platform)
  • Consent (for cookies, marketing, or optional features)

International Data Transfers

We operate globally. Your data may be transferred to countries outside your own, including the United States, where data protection laws may differ. We ensure all such transfers comply with GDPR requirements using Standard Contractual Clauses or equivalent safeguards.

Our Approach to Cookies

Cookies are small text files stored on your device that help our service work smoothly. They help us remember your preferences (like your language) and keep you logged in. We also use them for:

  • Functionality: To ensure the service works as expected.
  • Analytics: To understand how our service is being used so we can improve it.
  • Security: To help stop bots and prevent malicious behavior.
  • Internal Measurement: To measure the performance of our in-house promotional content and communications.

You have full control over cookies and can block or delete them through your browser settings.

Keeping Your Information Safe

Protecting your data is a top priority. We use a combination of technical, administrative, and physical safeguards to secure your information.

  • Encryption: We encrypt data to protect it both in transit and at rest.
  • Access Control: We strictly limit who can access personal information to only those employees who need it to do their jobs.
  • Monitoring: We constantly monitor our systems for vulnerabilities and potential threats.

Data Retention: How Long We Keep Things

We keep your information only as long as we need it to provide our service to you or to comply with legal obligations.

  • Account Information: We retain your account information for as long as your account is active.
  • User Content: Your files are automatically and permanently deleted from our servers within 48 hours of their expiration date, unless you choose to delete them sooner.
  • Safety-Related Data: If your content is flagged for illegal activity or a violation of our terms, we may retain limited information for a period to ensure the safety and security of our platform.
